Michael B. long <br />Denver, CO 80204 Division Director <br />RE: File No. M-1986-159; Preliminary Adequacy Review for 112 Construction <br />Materials Amendment Ol <br />Deaz Mr.Reckentine: <br />The Division of Minerals and Geology has completed its preliminary adequacy review of <br />your 112 construction materials reclamation permit amanedment. The amendment was <br />received on April 11, 2002 and called complete for review on April 29, 2002. The <br />decision date for this application is July 29, 2002. Apre-operation inspection was <br />conducted on May 10, 2002. Please be advised that if you aze unable to satisfactorily <br />address any concerns identified in this review before the decision date, it will be your <br />responsibility to request an extension of the review period. If there are outstanding <br />issues that have not been adequately addressed prior to the end of the review period, and <br />no extension has been requested, the Division will deny this application. <br />The review consisted of comparing the application content with specific requirements of <br />Rule 6.4 and 6.5 of the Minerals Rules and Regulations of the Colorado Mined Land <br />Reclamation Board for the Extraction of Construction Materials. Any inadequacies aze <br />identified under the respective exhibit heading along with suggested actions to correct <br />them. <br />APPLICATION FORM. ITEM 3 Permitted Acreaee: The form submitted with your <br />amendment indicates 259 permitted acres. The Division of Minerals and Geology <br />(DMG) records show 182.7 permitted acres, with the maximum to be disturbed at any <br />one time of 81.5 acres. <br />It is noted that your ownership information in Exhibit A indicates the size of the pazcel is <br />266 acres plus an easement for an access road of approximately 3.5 acres. <br />The amendment needs to begin with the assumption that the 16.9 acre release requested <br />sepazately has been granted, reducing the permitted acreage from 182.7 to 165.8 acres. <br />This would be the amount entered in line 3. Line 3.1 would indicate the amount of <br />acreage increase, 16.9 acres, and line 3.2 will indicate 182.7 acres. <br />
