RE: Request for Release of Liability - Nucla Mine, Permit
C-81-008
Dear Mr. Mount:
With completion of the change of land use at Nucla Mine of
42.2 acres to industrial/commercial at the request of
Montrose County for expansion of the Nucla landfill
operation (approved by CMLRD on February 28, 1989),
Peabody is now requesting a release of liability and
removal from the C-81-008 Permit of 55.6 acres which is
owned by Montrose and San Miguel Counties.
The area to be deleted from the permit area includes the
lands designated as industrial/commercial on Exhibit 22-3
(Postmining Land Use Map). These lands include the
request by Montrose County that the temporary bypass road
and topsoil stockpile No. 1 be turned over to them for
their use (letter from Montrose County to CMLRD, June 29,
1988)
The Division is already in receipt of Montrose County's
authorization to operate the land fill at this site
(transmitted to the Division by letter of January 6,
1989). There is sufficient overburden material available
to the County to properly conduct their operation and
reclaim their landfill when the operation is complete.
The nature of the landfill operation requires that no
backfilling and grading be completed in Area No. 4 so that
the County may conduct its operation efficiently.
Therefore, reclamation standards on the 55.6 acres have
been met.
Peabody is not requesting a reduction in the bond held at
Nucla Mine at this time. We are only requesting a release
