Co <br />Aa you know, THE Aggregate Source has applied to tlha State <br />Mining and Geology Division for an expansion and extension <br />of its mining Perait. Since Kr. Tezak purchased the quarry <br />mining and transport of product have increased many fold. <br />we residents of Tunnel Drivs have experienced a steadil~v declining <br />Quality of /ifs in recent months due to the operator's <br />inability to moat the restrictions of his conditional use <br />permit. We have worked closely with the Fremont County <br />Planning and Zoning Department and Code Enforcement Officer, <br />Hark Kitchell to attempt to bring the operator into compliance. <br />Since June,we and other residents of Tunnel Drive ;Rave <br />submitted alo~ost weekly casiplalnts to the County re: <br />gravel, sand, and rock spillage on the street in front of our <br />haves and the 3LSd~endant dust which billoMS into our bootees <br />when vehicles drove through the spillage. <br />Despite two warning letters fray Kr:. Kitchell, the <br />operator has failed to oaaply. Thanks to your recent i~nter- <br />vsntion, the street has bean partially cleaned, but in f rout of <br />my house there raaains a sand strip mreasuring 23 inches wide <br />and between 1/8 and 1/~ inch thick. Hence, my dust problem <br />continues. <br />With his past and currant difficulty in meeting this condi- <br />tions of his special use permit, Mre question his abilit~v to <br />manage the dust problems of his proposed expansion. Wye note <br />that his current plan for expansion deals with dust control <br />only on site and not on Tunnel Drivs. Hay we briny t~~ your <br />attention the urgent need for an effective dust control plan <br />for Tunnel Drive. Kr. Tezak is seeking an alternative road <br />
