Schreiner <br />Environmental Protection Specialist <br />Div. of Minerals and Geology <br />1313 Sharman St., Rm. 215 <br />Denver, CO 80203 <br />Dear Mr. Schreiner: <br />I enclose copies of corresondence between the County <br />and Mr. Tezak opf which i believe you should be aware as <br />you make your recommendation to the Reclamation Board. <br />I also include my correspondence with Millie Turner, of the <br />State Air Quality Division. <br />Mr. Kclo's fugitive dust control program addresses <br />on site activity only. Recently we observed Tezak trucks <br />h3ultpfoals without tailgates. The CvuntY substantiated that <br />and tells us that Mr. Tezak is now in the second stage of <br />violation of his permit. There will be a meeting betweeen <br />Mr. Tezak and the Commissionors at which time the County will <br />determine penalties for noncompliance. <br />On or about October 6th this neighborhood experienced <br />a heavy blast from the auarrY which shook houses; the <br />Smith residence sustained some ceiling damage. <br />As you can see, problems continue with fugitive dust <br />and blasting. We really need a dust control plan which <br />will relieve spillage and dust from it on Tunnel Drive. <br />Negotiations continue between Mr. Tezak, the City, <br />and Pueblo Community College for easements which will <br />allow Mr. Tezak to build an alternate road.
