<br />Michael Neumann <br />May 4. 1998 Page 2 <br />1996 Reinitiation of Shrub Parcels' Bond Release Liability Period <br />As established in TR-62, the bond release liability period for the shrub augmentation <br />parcels was reinitiated for an additional five years. The five-year period commenced <br />June 6, 1996, the day following completion of the initial planting of the parcels. The <br />reinitiated liability period is only five years duration, rather than ten years, because the <br />shrub parcels were considered to be a restricted transplanting of native species as <br />allowed in Section 4.15.7(5). The five-year period was assigned to the parcels as if the <br />initial planting of the parcels had occurred at the end of the fifth year of the permit <br />area's original [en-year liability period. The five-year liability period will end June 5, <br />2001, at least 3 years before the earliest possible end date for the slump, assuming the <br />liability period is not further reinitiated by an unforeseen circumstance. <br />1997 Non-Reinitiation of Shrub Parcels' Bond Release Liability Period <br />Transplanting that was done in the parcels in Summer 1997 did not reinitiate the five- <br />year bond liability period because the intention of TR-62 was to allow additional <br />planting within the shrubs parcels during the five-year liability period commencing June <br />6, 1996. The additional planting is explained in item t!5 of your letter to the Division <br />dated February 12, 1996 concerning MR-62. <br />The Division is prepared to approve the work proposed for MR-13 given the bond <br />liability time-frames described above.
