:~
' ~a,/,~
(e~'e~
~n
T~
May 4, 1998
Mr. Michael R. Neumann
TerraMatrix
P.O. Box 774018
Steamboat Springs, CO 80477
Re: Hayden Gulch Mine, Permit No. C-80-003
Minor Revision MR-13
Slump Mitigation
Dear Mr. Neumann:
III IIIIIIIIIIIIIIII
999
The Division has completed its review of the application that you submitted for MR-13.
The review benefited from the phone discussion on May 1 between you, me, Bob
Medler of HG Coal, and David Berry of the Division regarding bond liability periods
of the slump and shrub parcels.
Your cover letter for MR-13 dated March 27, 1998 explains that the operator
"....intends to take these precautionary (slump mitigation) measures now so that the
area will be eligible for bond release at the same time as the shrub augmentation
parcels." Our review finds that the bond release liability periods of the the slump and
the shrub parcels will not coincide; therefore, the goal of this Minor Revision of
synchronizing the [wo liability periods would not be achieved.
The following paragraphs describe the Division's understanding of the two bond release
liability periods.
1.994 Reinitiation of Slump's Bond Release Liability Period
The bond release liability period for the slump was reinitiated in September 1994 when
a french drain was installed (please refer to our letter of 8125197 for MR-12). The
work now proposed for MR-13 would not reinitiate the slump's liability period.
Therefore, the liability period for the slump will end in the year 2004, assuming an
unforeseen event does not cause further reinitiation. Reinitiation of a full 10-year
liability period for substantial work on the slump is required by Section 4.15.7(5).
