Box 774018 <br />Steamboat Springs, CO 80477 <br />Re: Hayden Gulch Mine, Permit No. C-80-003 <br />Minor Revision MR-13 <br />Slump Mitigation <br />Dear Mr. Neumann: <br />III IIIIIIIIIIIIIIII <br />999 <br />The Division has completed its review of the application that you submitted for MR-13. <br />The review benefited from the phone discussion on May 1 between you, me, Bob <br />Medler of HG Coal, and David Berry of the Division regarding bond liability periods <br />of the slump and shrub parcels. <br />Your cover letter for MR-13 dated March 27, 1998 explains that the operator <br />"....intends to take these precautionary (slump mitigation) measures now so that the <br />area will be eligible for bond release at the same time as the shrub augmentation <br />parcels." Our review finds that the bond release liability periods of the the slump and <br />the shrub parcels will not coincide; therefore, the goal of this Minor Revision of <br />synchronizing the [wo liability periods would not be achieved. <br />The following paragraphs describe the Division's understanding of the two bond release <br />liability periods. <br />1.994 Reinitiation of Slump's Bond Release Liability Period <br />The bond release liability period for the slump was reinitiated in September 1994 when <br />a french drain was installed (please refer to our letter of 8125197 for MR-12). The <br />work now proposed for MR-13 would not reinitiate the slump's liability period. <br />Therefore, the liability period for the slump will end in the year 2004, assuming an <br />unforeseen event does not cause further reinitiation. Reinitiation of a full 10-year <br />liability period for substantial work on the slump is required by Section 4.15.7(5). <br />
