' -. <br />Letter to Richard L. Fanyo -2- September 27, 1995 <br />COM, Inc. will be required to comply with the notification requirements <br />of Rule 4.16(2), and provide the Division with proof of notification of <br />the county and the owner(s) of the affected land prior to the end of the <br />60 day review period. The Division intends to utilize the 60 day review <br />period to update the estimate of site reclamation costs based on all <br />information currently available. The site inspection criteria of Rule <br />4.16(5) is not strictly applicable in this case, since the Division will <br />probably inspect the Gold Hill Mill several times during the 60 day <br />period. <br />In a separate matter, the Division's most recent correspondence sent to <br />Tim Hartley at Boulder P.O. Box 17304 was returned by the Post Office with <br />the notation that the P.O. Box had been closed. Mr. Hartley is listed as <br />the Division's primary contact in the Gold Hill Mill permit, and the <br />Boulder P.O. Box is listed as the primary address for COM, Inc. in the <br />permit correspondence file. Rule 1.16 of the Mineral Rules and <br />Regulations states: <br />It shall be the duty of the operator to keep the Office notified of <br />any mailing address change by promptly sending written notice of <br />such change to the Office. The Office is entitled to assume, in the <br />absence of such Notice, that it may proceed with the last previous <br />address provided by the Operator, and the operator will be bound by <br />such Notice as if actually received. <br />Please provide the Division with the name and address of the primary <br />contact for COM, Inc. so that our data base can be updated. Many of the <br />Division's procedures and notifications are automated, and inaccuracies <br />in the data base could result in compliance problems caused by official <br />mailings that may not be received by the operator. <br />If you have any questions, please contact me. <br />Sincerel , <br />./. <br />Allen C.
