Lochhead <br />E.ecmive Dircaor <br />nnchzel B. tong <br />Division DuttlUl <br />Re: Financial Warranty Reduction Request, Colina Oro Molina (COM}, Inc., <br />Gold Hill Mill, Permit No. M-94-117 <br />Dear Mr. Fanyo: <br />The Division has reviewed your submittal, dated September 21, 1995, <br />requesting that the West One Bank of Washington Certificate of Deposit in <br />the amount of $45,263.00, currently held as a component of the Financial <br />Warranty for the Gold Hill Mill, be replaced by a Check for Deposit in the <br />State Treasury in the amount of $7,938.00. The Division recognizes that <br />the circumstances that led to your request to replace the existing bond <br />with a bond in a lesser amount were caused by the timing of a decision <br />rendered by the Boulder County Land Use Department, however, there is no <br />mechanism for processing your request other than that mechanism described <br />for reduction of warranty amount found in Rules 4.13 and 4.16 of the <br />Mineral Rules and Regulations of the Mined Land Reclamation Board. This <br />procedure must be followed by COM, Inc., with the following exceptions: <br />1. The Division will waive the requirement of Rule 4.13 to "include an <br />estimate of the actual cost to reclaim the site based on what it <br />would cost as independent contractor to complete reclamation". The <br />justification for this waiver is that COM, Inc. provided estimates <br />2. <br />3. <br />of this nature during the very recent re-permitting process for the <br />Gold Hill Mill. <br />The Division will waive the requirement for a Reclamation Report and <br />photographs as detailed in Rule 4.16(4). The justification for this <br />waiver is that the basis for the surety reduction request is <br />administrative, rather than being related to any actual reclamation <br />work completed. <br />The Division will not require COM, Inc. to submit the release <br />request via Certified Mail, but will establish September 21, 1995 as <br />the initial date for the 60 day compliance review period described <br />in Rule 4.16(5). <br />
