Energy Fuels needs to <br />submit verification from the owner ,San Isabel Power Company, that these lines and <br />poles are the property and responsibility of San Isabel, and verification of whether <br />they will remain or be removed. <br />To summarize, items the Division requires to resolve these itemized concerns include; an <br />explanation of the variance in the reported length of the permanent diversion culvert, <br />demonstration to qualify the sediment pond to remain beyond phase III bond release, a <br />commitment from Energy Fuels that the small water tank will be relocated to one of the <br />permanent structures, the light use roads must be reclassified and upgraded to access roads <br />to remain as permanent, reclamation estimate costs need to be submitted for all remaining <br />reclamation tasks, certified copies of maps 12 and 17-1, and a letter from San Isabel Power <br />Company verifying ownership and responsibility of remaining power lines and poles. <br />The Division's projected decision date is scheduled for April 19, 1995. Submittal of this <br />information by April 10 should allow the Division adequate time to review and make a <br />decision by the proposed date.
