<br />C-82-055: 'rR-17 Mr. AI Weaver 3 <br />8) Steel Water Tanks: Two water tanks are requested to remain by the landowner as <br />expressed in the March 16, 1994 and the July 27, 1994 letters. One tank has a <br />capacity of 150,000 gallons and is located North of the concrete pads. This tank is <br />fed by a 4 inch pipe by a well owned by Energy Fuels. Documentation of well <br />ownership was provided to the Division in a letter from Energy Fuels dated August <br />10, 1994 fulfilling the requirements of Stipulation No. 8. This tank may be utilized <br />as a water source for the ranching operation. The second tank is a 10,000 gallon <br />tank and is currently (March 8, 1995) stored next to the shop building. This tank is <br />proposed for additional support of the postmining cattle operation. <br />In agreement with Rule 4.16, the Division finds these tanks to support the pre- <br />and postmining land use of rangeland. The Division also finds that the smaller tank <br />needs to be moved and stored at one of the permanent structures. On-site <br />discussions with the landowner in January 1995 indicated that the landowner intends <br />to move the small tank to the concrete pads. This would be acceptable with the <br />Division. <br />Additional items included in the revised pages of this revision are: <br />9) Pond Light Use Road (page 351) and Powder Magazine Light Use Road: Although <br />these roads have been requested by the landowner (letter dated July 27, 1995) to <br />remain post mining, Rule 4.03.3(1)(d) does not allow "light use roads" to remain after <br />reclamation. Rule 4.03.2(1)(f) does allow for the retention of access roads. In order <br />for the two roads to be approved to remain, they need to be classified as access roads <br />and upgraded to meet the specifications of Rule 4.03.2(3). <br />Additionally, the pond road has been requested to remain for access to the pond. <br />However, until the demonstrations required in item 5 have been provided and <br />approved, the road to the pond cannot be considered as permanent either. <br />Please reclassify these roads as "access roads" and assure they meet the criteria of <br />Rule 4.03.2(3) if they are to remain as permanent. <br />10) This revision proposes to omit pages 486Ra through 512Ra. These pages consist of <br />landowner letters that have been resubmitted as Addendum E, and reclamation cost <br />estimates. The tasks for a fair portion of the reclamation estimate have been <br />completed, but the estimated costs for remaining tasks such as, topsoil application <br />(if topsoil substitute is unsuccessful), seeding, mulching, removal of Diversions 3,4 <br />and 5....and other applicable tasks, must remain in accordance with Rule 3.02.2. <br />These costs may be included as an addendum or a separate submittal. <br />11) This revision also includes draft copies of maps 12 and 17-1. Map 12 does not reflect <br />the current topography of the mine site. Energy Fuels cover letter dated <br />
