3. The Division is assuming that culverts A8, 31a, Sla, 52a, 52aa, 53a, and 64a (all located azound <br />office and shop facilities areas) will be permanently retained. If this is the case, please update <br />Exhibit 7-19, Postmining Drainage Control to include those culverts. <br />4. Please be awaze that permanent retention of the listed facilities would not relieve Seneca Coal <br />Company from the requirements of the rules and permit regarding disposal of non-coal waste and <br />contaminated or hazardous materials. Specifically, Seneca Coal Company will still need to cleaz <br />the boneyards, facilities yards, and storage azeas of scrap material, equipment, machinery, <br />storage drums, etc. Seneca Coal Company will also have to remove and properly dispose of any <br />contaminated soils on site. These requirements aze detailed in Rule 4.11.4, and aze discussed in <br />Tab 13 of the permit application (beginning on page 13-45). <br />New Page 13-7a indicates that Seneca Coal Company is requesting a change in land use <br />designation (to rangeland) on 37 acres. The currently approved permit application package, on <br />Page 13-3, designates the post-mining land use for the entire permit azea as primarily livestock <br />grazing (rangeland) with a secondary use of wildlife habitat. Accordingly, no change in land use <br />designation is required. Please revise page 13-7a to omit the reference to a change in post- <br />mining land use designation. <br />6. Please be advised that once bond release is granted on these structures, a permit will need to be <br />obtained for the aboveground fuel storage tanks on site. Permits aze issued by the Department of <br />Labor & Employment; additional information is available at <br />htt~://oil.cdle.state.co.us/OIL/StatutesRe~ulations/astreas.asp.
