7) The Mining Plan, Exhibit D, should explain in detail the starting point of excavation <br />and the sequence of proposed activities in both Mining Areas. It is not necessary to <br />explain all 24 phases in the Mining Areas, however the first three should give <br />anybody reviewing the permit a feel of the planned events. Please review the Plan <br />for conformance with Rule 6.4.4 <br />8) If the operation is aphase-planned operation; how can disturbance in "several <br />areas" occur at the same time? If the North Area and Middle Area are to be <br />disturbed concurrently, the Division will require bonding to cover both. Please <br />clarify. <br />9) No mention is made of fuel storage within the permitted area. Please clarify if there <br />will be any. If there is, the Division needs to know secondary containment <br />structures, amount proposed on site, and a statement that the Division will be <br />notified along with all other required federal, state and local agencies in the event of <br />a spill of any "reportable quantity". <br />10) Please find enclosed, response from the Office of the State Engineer. Please <br />supply documentation that the issues raised have been clarified and accepted by <br />that Agency concerning water issues. Also, these issues should be addressed in <br />Exhibit G. <br />1 1) The Middle and North Areas do not appear to be continuous. Please clarify. <br />If undisturbed lands do not connect the Areas, the Board requires two 12) separate <br />permits. Please clarify. <br />12) Exhibit L has a task for cut and fill of any highwalls. The Mining Plan clearly <br />states that mining will be conducted at 3H:1 V slopes. Therefore, there should <br />never be any highwalls to cut. Please Clarify. <br />These reviewed issues do not imply that all other requirements are met. Further adequacy <br />review will be undertaken on this application as relevant information is supplied and <br />analyzed. This Office should receive response to this PAR no later than 3/31/03, so that <br />staff can allocate adequate time for further review.
