This request is being submitted pursuant to Rule 3.03.2 of the DMG Regulations and in <br />accordance with pre~~ously established timeframes. CYCC is requesting final release of liability on the <br />reclaimed area which comprises the North and South Blocks of Mine 3, for a total bond reduction of <br />$200,000. The currently approved postmining landuse within which the blocks are located is pastureland. <br />These areas were reclaimed in accordance with the approved reclamation plan and were seeded between <br />September of 1979 and June of 1982 cuing the approved seed mixture. The approved seed mixKUre is <br />• presented on Table A of this submittal. Given that these parcels have been effectively reclaimed, are <br />adequately controlling erosion, and meet or exceed the standard as established by the associated reference <br />areas, CYCC believes that reclamation has been successfully completed at this site. Therefore, CYCC <br />contends the reclamation bond required by this permit should be released for both Phase II and Phase III <br />liability. <br />The total acreage for which release is being requested is 368 acres, as denoted on the enclosed reap. The <br />North Block contains 122.6 acres, and the south Block contains 245.4 acres. Each block was sampled per <br />the criteria established with the Division. ` <br />The summary values for cover, productioq and sample adequacy for the Noah Block may be found on <br />summary Tables I and 2 for 1995 and on sumatary tables 3 and 4 for 1996. Please note that the bon3~ <br />release values re}led the incorporation of desirable species only, and do not include annuals, biennials, <br />noxiotu weeds, or undesirable forts as previously discussed with the Division. The associated Reference <br />Area values pertaining to the North Block for both years aze shown on Summary Tables 5 through 12. <br />The summary values for cover, productioq and sample adequacy for the South Black may be found on <br />Summary Tables 21 and 22 for 1996 and on Summary Tables 23 and 24 for 1997. The associated <br />Reference Area values pertaining to the South Block area shorvn on Summary tables 25 through 40. The <br />bond release values derived fmm desirable species have been utilized for the reference area in the interest <br />of consistency. The aforementioned tables also contain information pertaining to the number of hits for <br />litter, bare ground, rock and undesirable and non-perennial species. <br /> <br />
