Long <br />' Div~s~on Director <br />Re: Trapper Mine, Permit No. C-81-010, SL-03, Lippard Spring Ivo. ] Concern <br />Deaz Mr. Koehler: <br />The Division has received a letter of concern from neighboring landowners, Mr. and Mrs. Francis Lux; <br />in response to Trapper's phase II bond release inspection application, SL-03. The Lux's contend that <br />dirriunition of flow of a natural spring, the Lippazd No. 1 Spring, is a result of mining impacts.. The SL-. <br />03 bond release azea lies to the south and upslope of the spring in question. Mr. and Mrs: Lux, you and I <br />located the Lippard Springs No. 1 and No. 2. on November 8, 2001 when I was at the mine site Yor. the <br />bond release inspection. <br />Rule 4.05..1(1) requires that mining activities be planned and conducted to prevent material .damage to <br />the hydrologic balance outside the permit area. Please submit a response to the LuX's letter, dated. <br />November 27, 2004, to the Division. The Division requests a detailed geologic cross,sectilire that.ivould . <br />illustrate the portion of the mine that. could impact the Lippazd springs. In accordance with Rule " <br />2.05.6(3)(b)(iiil, this information may be inserted into the permit probable.hydxologic wnsequences. <br />(PHC) section of the permit. Attached, please find criteria of what the cross-set:tion should include. <br />The letter of concern regarding the Lippard Spring No. I was submitted in.response to public <br />notification of the SL-03 phase II bond release application. Phase II bond release criteria is used to' <br />assess the reclamation success of re-establishment of vegetation which supports the post-mining land <br />use, and used to evaluate suspended solids from the reclaimed azea. The Division considers the concern <br />of diminished flow from the spring a valid concern, but not applicable to SL-03.
