<br />In conjunction with the previously approved TEA, an addendum was <br />prepared in response to a technical revision (dated September, <br />1985) to the permit. The addendum updated the status of the <br />operation and documented compliance with the Act. For <br />administrative purposes, the Division subsequently issued Permit <br />No. C-81-071 to CYCC for Eckman Park, Mine 1, and Mine 2. <br />The operator changed from Energy Fuels Corporation to Colorado <br />Yampa Coal Company during November, 1981. On May is, 1983, the <br />Foidel Creek Mine was added to Permit No. 79-177, and on July 29, <br />1983 the underground and surface facilities were split into two <br />separate permits. Twenty Mile Coal Company assumed responsibility <br />for the Foidel Creek Mine and Colorado Yampa Coal Company retained <br />responsibility for the surface operations. On May 3, 1986, a <br />succession of operator occurred which transferred responsibility <br />for the surface operations (C-81-071) from Colorado Yampa Coal <br />Company, a subsidiary of Getty Coal Company, to Colorado Yampa Coal <br />Company, a subsidiary of Cyprus Western Coal Company. <br />The` Permit No. C-81-071 expired December 14, 1986, and the <br />subsequent renewal (RN-O1) resulted in a new permit being issued, <br />with the issuance date set at December 14, 1987. This was an <br />error. The date of issuance should have been set at December 14. <br />1986 corresponding to an expiration date of December 14. 1991 not <br />December 14, 1992. This error was corrected during Permit Renewal <br />~2 (RN-02) by back-dating the second permit renewal to December 14, <br />1991. Therefore the midterm of the 5 year permit is June 14, 1994. <br />Since RN-02, no mining or significant reclamation has been done. <br />All disturbed areas associated with this permit have been reclaimed <br />with the exception of approximately 5 acres at the location where <br />the Marion dragline is parked. This dragline has been recently <br />sold and should be removed from the permit area in approximately <br />one year. The mine remains in active status, though all coal has <br />been mined and reclamation activities are minimal.
