Ilabitat management and creation shall be directed toward encour- <br />aging the maximum practicable diversity of both game and non- <br />game species, mid the encouragement of a maximally integrated <br />ecosystem capable of withstanding all reasonably expectable <br />climatic extremes for the reclaimed land. <br />VI. FNFORCEA~ff <br />A. Inspections and hbnitoring. <br />1. The Board, the Reclamation Section of the Department, the Division <br />of Aiincs, or their authorized representati.vc may enter upon af- <br />fected lands of the operator at all reasonable times for the pur- <br />pose of inspection to determine wlretirer there ]ras been compliance <br />with the provisions of the Act and the rules promulgated there- <br />under. <br />2. All reclamation inspections shall include the filing of a report <br />at the: <br />a. Alain offices of the Board; and <br />b. Offices oL the operator; arrd <br />c. Aline office; and <br />• d. Office oC the County Commissioners or corurty plmurirrg office, <br />or the municipality where the open mining operations occur. <br />3. ~lll violations shall be reported immediately, in writing, to the <br />operator and to the Board. <br />4, faclr operation holding a permit shall lie inspected a sufficient <br />rrumlrer of times each year to insure the operator maintains con- <br />formity with the reclamation plan. The frequency of inspection <br />shall be dote mined by the extent of the operation, the rate at <br />which the mining proceeds into ruunined ]ands, and the degree of <br />possible errvironmerrtal impact the operation might have. <br />5. 'I'lie Board or their designees shall aruiually inspect seeded areas <br />at the end of tine growing season at the respective site to as- <br />certain if the approved reclamation plan is being successfully <br />implemented l,y determining species diversity, germination, seed- <br />ling take, mrd regenerative mrd successional trends where such <br />considerations arc applicable. If the Board determines the <br />seedings or plantings are wrsuccessful in terms of good germina- <br />tion and/or seedling take, or the vegetation is not developing <br />(regenerating and/or succeeding) as was expected, irnrnediate irr- <br />vesti.gative action shall be taken by the operator at the request <br />of the board to determine the cause so that alternatives can be <br /> <br />
