Oehler, Environmental Protection Specialist <br />RE: File No. M-92-051, Adequacy Items <br />The following items must be addressed by the applicant in order to <br />satisfy the applicable requirements of C.R.S. 34-32-101 et. seq. and <br />the Mineral Rules and Regulations of the Mined Land Reclamation <br />Board: <br />Exhibit D - Mining Plan <br />1. Your paragraph (a) states "since this site will be reclaimed for <br />industrial use, it will not be necessary to save any topsoil or <br />growth media for reclamation." Rule 3.1.9(1) states that where <br />it is necessary to remove overburden in order to mine the <br />construction material, topsoil shall be removed and segregated <br />from other spoil. Rule 3.1.10 does not eliminate the <br />requirement for industrial sites to be reclaimed. Rule 6.4.5(2) <br />requires that "Reclamation shall be required on all the affected <br />land". <br />2. Your paragraph b does not describe the handling of topsoil and <br />other overburden materials. Please provide this information. <br />~`3. Your paragraph c states that there are no impoundments. I have <br />noticed a small impoundment on the south edge of the carestia <br />pit portion of the proposed conversion area. I presume this is <br />related to the spring. If I am correct, please discuss this <br />impoundment. <br />4. Your paragraph e(i) states "After this original area is <br />depleted, the mining will continue in a northerly manner in that <br />area in the northwest of the Section 21 portion that is <br />unmined". It is assumed that you are referring to the area <br />marked Future Mining. If this is the case, you must include <br />this area within the affected land boundary. If this is not <br />done, it will have to be added by amendment at a later date, <br />before it is affected by a~ mining activity. Your bond will <br />still be calculated on a 35 acre disturbance requiring all steps <br />of reclamation. <br />5. Your paragraph e(ii) states "The portion in Section 20 will be <br />opened shortly." The Division assumes that you are referring to <br />the 11.5 acre area within the affected land boundary. The <br />statements in 4 above apply to the remaining area in Section 20. <br />
