Please address the following <br />comments. <br />Item 1. Statute 34-33-110(6): Each applicant shall submit to the office as part of the permit <br />application a blastingplan which shall outline the procedures and standards by which the <br />operator will meet the provisions of 34-33-120(2)(0). <br />DIVISION O F <br />MINERALS <br />GEOLOGY <br />RECLAMATION <br />MINING•SAFETY <br />Bill Owens <br />Governor <br />Greg E. Cattany <br />Acing Division Director <br />Surface coal mining operations are required by Statute 34-33-120(2)(o)(I) to provide daily notice, <br />prior to blasting, to resident occupants in areas within one-half mile of any blasting site. The term <br />"resident occupants" would include seasonal (summer) Colowyo employees who reside, albeit <br />temporarily, in Colowyo-owned structures that aze situated within one-half mile of blasting sites. <br />Statute 34-33-120(o)(I) allows operations to provide for less frequent notice as each such resident <br />occupant shall approve in writing. <br />Please revise permit sections 2.05 and 4.08 to acknowledge that Colowyo will, as <br />circumstances require, provide daily notice prior to blasting to resident occupants, including <br />seasonal Colowyo employees, situated within one-half mile of any Colowyo blast site. This <br />new language should describe how Colowyo will, when necessary, accomplish this daily <br />notification, and should also include a statement that Colowyo will provide less frequent <br />notice to these resident occupants only as each resident occupant shall approve in writing. <br />Item 2. Rule 2.05.3(6)(a): If appropriate for the proposed operation, each plan should also <br />include a surface blasting plan for the proposed permit area, explaining how the applicant intends <br />to comply with the requirements of 4.08 and including the following: <br />
