File C-81-019, TR-53 <br />June 28, 2001 <br />Page 4 of 13 Pages <br />TR technical revision <br />Rule 1.04(136) "Technical revision"means a minor change, including incidental permit <br />boundary revisions, to the terms or requirements of a permit issued under these Rules, which <br />change shall not cause a signiftcant alteration in the operator's reclamation plan. The term <br />includes, but is not limited to, increases in coal production, reduction or termination of approved <br />environmental monitoring programs, or design changes for regulated structures or facilities. <br />The proposed action is considered as a technical revision as it will not cause a significant <br />alteration in the operator's reclamation plan. It is a change in the environmental monitoring <br />program. <br />*Rule 2.07.3(1): Upon submission of an application for permit or revision or renewal thereof, <br />the Division shall, within 70 days of receipt of said application, review the submission and <br />determine if it is complete. z If the application is complete, the applicant shall be duly notified <br />and the application shall be considered filed for purposes of the Act3. If the application is <br />incomplete, notice to that effect shall be mailed to the applicant within said 70-day period, and <br />the applicant shall be given the opportunity to amend, review, or otherwise make said <br />application complete4. <br />~ December 12, 2001 <br />a Compliance with Rules 2.07.3(2) thraugh 2.07.3(2)(8) and 2.08.4(5) through 2.08.4(5)(d) below <br />is a prerequisite for a determination of complete. The rules are indicated with an asterisk in this <br />review. The Application was found complete on December 14, 2001. <br />3 The applicant was advised of completeness of the application by letter of December 14, 2001. <br />a The Application is, by exception, in compliance with this rule. No amendment to the <br />application was required for completeness. <br />*Rule 2.07.3(2): At the time ofsubmission of an application for a permit, or for a permit <br />revision, technical revision, or renewal of an existing permit, the applicant shall submit to the <br />Division the proposed notice of publication of the ownership, precise location, and boundaries of <br />the land to be affected by the proposed surface coal mining operation. ~ Upon notification to the <br />applicant that the application for permit or the application for a permit revision or renewal is <br />complete, the applicant shall place the notice of ownership, precise location, and boundaries of <br />land to be affected by the proposed surface coal mining operation in a local newspaper of <br />general circulation in the locality of said operation.z This publication shall be published at least <br />once a week for four consecutive weeks.3 The publication shall contain, at a minimum, the <br />following information4. <br />~ The proposed notice was submitted with the application, and was found to be complete on <br />December ] 4, 2001.
