16b. The Applicant references at least 4 adits and 3 shafts with the Cash Mine, Who Do Mine, <br />and Mount Royale permit azeas. These include the Cash Shaft, Who Do Shaft, St. Joe Shaft, <br />Donald R Adit, Belleview Adit, Mount Royale Adit #1, & Mount Royale Adit #2. In <br />conformance with Rule 6.3.4(2) please clarify which of these mine openings, except for the <br />Mount Royale Adit #1, have been used or affected since September 7, 1983 (permit issuance). <br />For those that have, please indicate whether the opening has been deemed adequately reclaimed <br />by the Division or whether further measures will be required to properly secure the opening for <br />final reclamation. Also, the Division will require plans for securing or final reclamation for mine <br />openings and associated costs prior to re-disturbance or construction of any mine opening to be <br />used during future mining operations, such as the Mount Royale Adit #1. These plans for <br />securing or final reclamation of the mine opening must meet the minimum requirements of the <br />"2004 General Bid Specifications of the Colorado Inactive Mine Reclamation Program". Please <br />note that the itemized cost for upgrading existing mine openings ($1,500) and itemized cost for <br />new concrete/steel closure ($3,500) noted in Tables D-1 and D-2 of the amendment application <br />must be adequate to meet the minimum requirements for final reclamation as specified in the <br />2004 General Bid Specifications. Under the terms of this amendment application, MRV may <br />provide the details of what upgrades aze needed and associated costs for each mine opening by <br />February 21, 2006 or may commit to providing such information in the form of a technical <br />revision to permit M-1983-141 within 60 days of the decision date of this amendment application <br />and secure approval of such revision within 90 days of the decision date of this amendment <br />application. Please respond. <br />6.3.6 EXHIBIT F -List of Other Permits and Licenses Required <br />17. It is the Division's understanding that MRV will maintain a "zero dischazge" facility at the <br />Cash Mine by re-circulating water collected in the various sump's within the Cash Mine for mine <br />use and/or return back to the Cash Mine shaft or other mine workings. In conformance with rule <br />6.3.6, please verify whether the applicant will seek anEPA-UIC Permit in order to conduct the <br />proposed mining operations, and if so what limitations such permit would impose on the water to <br />be re-directed back into the Cash Mine shaft or other mine workings. <br />18. MRV has indicated that they will construct and operate a water well and septic system in <br />conjunction with the Mount Royale No.l Adit operations, and that they will obtain the <br />appropriate well permit and withdrawal right to support consumptive uses associated with the to- <br />be-constructed water well or other applicable activities. Please indicate MRV's timing for <br />obtaining the well permit from the Office of the State Engineer (OSE), ie: at what time during the <br />sequence of proposed mining activities will the well permit be obtained and the well constructed. <br />If the needed OSE well permit has not been obtained by the amendment decision date, then <br />MRV may commit to providing the Division with written demonstration of the OSE well permit <br />prior to construction of the well. Also, MRV will need to provide the details of the well location, <br />and well design and construction. The applicant (MRV) may provide all such details prior to <br />February 21, 2006 or may commit to submittal of this information in the form of a technical <br />revision to Permit M-1983-141 within 30 days of the decision date of this amendment application <br />
