However, <br />I need to request another one-month extension to allow DMG enough time to come to a <br />decision in these matters. We will attempt to answer your comments with this <br />communication. <br />We have enclosed new maps as requested in your comment #1 and #2. The new map <br />includes all areas of the existing Montoya Pit. Please note that AM-03 issued in 1996 <br />was for 40 acres. We have already mined 10 acres of that 40 acres. The other 30-acre <br />parcel recently awarded to us by BLM has been divided into two sections, Phase 1 and <br />Phase 2. Phase 1 has been divided into Phase 1a and Phase 1b. Phase 2 has not <br />been specifically delineated yet so is not specifically included on the map. It will lie to <br />the north of Phase I. This 40-acre area is leased from the Bureau of Land Management. <br />Their terms are 30 additional acres or 10 years or 1,600,000 tons as scaled out, <br />whichever occurs first. We believe we will use the 1,600,000 tans first. It is entirely <br />possible this will occur before we enter the Phase 2 area. Therefore, BLM does not <br />want to map Phase 2 until a later date. C & J Gravel Products, Inc. is aware of the <br />ambiguity in the requirements of the Division of Minerals and Geology and the Bureau of <br />Land Management and we agree that we will not mine outside a 40 acre area without an <br />approved amendment from Division of Minerals and Geology. <br />We have attempted to include all the information required in Rules 6.2.1(2), 6.4.4 and <br />6.4.6 either on the map or in the mining and reclamation plan narratives. In addition to <br />Technical Revision #1 on the Mining Plan, we need to revise the narrative as follows: <br />MINING PLAN <br />(Starting with the third paragraph) <br />We plan to mine the permitted area starting at the southern boundary going west <br />and then north. We will mine in 5-acre increments.
