Such materials include liquid fuels (excluding liquefied propane);
solvents, lubricants, coolants, reagents, pesticides, etc. Some of the mining operations we regulate .
occur in or above alluvial ground water systems adjacent to stream channels. Other operations may
be located in, near, or over porous or highly fractured rock strata that may connect with nearby
aquifers.
The Minerals Rules and Reguiations define an aquifer as, "... a geologic formation, group of
geologic formations, or part of a geologic formation containing sufficient saturated permeable
material that could yield a sufficient quantity of water that may be extracted arid applied to a
beneficial use."
The Minerals Program is responsible for the protection of ground water, under the provisions of SB
181.
In order to fulfill our responsibility, it is necessary that the following Policy be instituted:
1.. Where an aquifer, as defined above, exists within the mining germit boundary or there is
connected to an aquifer at depth and the mining operation intends.to use and/or store toxic or
hazardous materials within the mining permit area, the Office must include the following
condition in all application approvals:
"A.reportable spill is a spill of any toxic or hazardous substance (including spills of
petroleum products) within the permit area reportable to any Division of the
Colorado Department of Public Health and the Environment, the national Response
Center, the Colorado Emergency Planning Commission, a local Emergency Planning
Commission, a local Emergency Planning Committee, or the State Oil Inspector.
The operator shall notify the Office of a reportable spill within the permit area using
the same timeframe required by the permit, license, notice, Act, Rule or Regulation
governing the reporting of the spilt to.the appropriate agency. Notice of a reportable
spill shall be Faxed to: Minerals Program Supervisor, Division of Minerals and
Geology, FAX (303) 832-8106.
