The revised pages are attached. <br />Cultural and Historic Resource Information; Rule 2.04.4 <br />49. Page 2.04-6 has been revised to address the Division's concern. A copy of the <br />revised page is attached. Table 6 did not require modification. <br />50. Rule 2.04.4: Existing Exhibit 6, "A Records Search and Reconnaissance Survey <br />for the Foidel Creek Mine Permit Area, August 1984", is a cultural and historic <br />resources survey. It was conducted at the time when the Foidel Creek mine <br />permit boundary (exhibit page 6-3, revised 11/26/86) was different than it is now. <br />Two sites, SRT157 and SRT162, are discussed in the first paragraph of page 6-20 <br />of Exhibit 6. The survey indicates that the sites are situated in Section 10, TSN, <br />R86W. The survey states, "Both sites are lithic scatters recorded by Grand River <br />Institute (Roebuck, 1980) during a survey for [he Pittsburg and Midway Mining <br />Company and have been recommended as needing additional data recovered from <br />the sites prior to making National Register eligibility recommendations." <br />A review of Exhibit 6 seems to find that as these two sites were situated outside of <br />the Foidel Creek permit revision boundary at the time of the prepazation of the <br />exhibit, the additional data needed for determining their listing eligibility was not <br />obtained. Page 6-22 of the exhibit states, "Colorado Yampa Coal Company and <br />Twentymile Coal Company... will not impact sites SRT157, SRT162, and <br />SRT330, located in areas adjacent to the permit boundary." <br />The Foidel Creek permit boundary now encompasses Section 10, TSN, R86W, <br />and, consequently, sites SRT157 and SRT162. Twentymile Coal Company, via <br />PR-O5, proposes undermining a portion of Section 10. It is possible, therefore, <br />that these two archaeological sites will be subsided, and possibly affected by the <br />surface effects of underground mine subsidence. It therefore appears that, in <br />accordance Rule 2.04.4(1), a discussion as to whether or not sites SRT157 and <br />SRT162 are eligible for listing on National Register of Historic Places should be <br />provided for the permit text. Please address. <br />51. Rule 2.04.4: Based upon proposed Map 23 (certified 9/10/99), portions of the <br />following sections in TSN, R86W will be undermined via PR-O5: 2; 7; 8; 9; 10; <br />l l; 13; 14; 15; 16; 17; 18; 21; and 22. <br />Based upon a review of confidential Exhibits 6, 6a-l, 6-C, 6D, 6E, 6F, 6g, and <br />6H, it appears that surveys for the presence of cultural and/or historic resources <br />listed or eligible [o be listed on the National Register of Historic Places and/or the <br />
