7) Please supply a coot/ of documentation to DMG staff, to the Office of State <br />Engineer, addressing noted issues stated in "Response to Reclamation Permit <br />Application Consideration" submitted to the Division concerning water related <br />issues. (copy enclosed). <br />8) The Division requires proof that all other applicable permits have been filed for, it is <br />not required that they have been issued. Exhibit M identifies that a NEPDES <br />stormwater permit, a COE 404 permit, a OSE well permit and a City of Rifle water <br />shed permit have not yet been applied for. Please clarify the status of these <br />required permits. The Division may have to require a stipulation that the Rifle permit <br />and the COE 404 permit be approved prior to any disturbance within the proposed <br />area. No discharges of water from the site can occur until the NEPDES permit is <br />approved. The Division will require a copy of all approvals, not the entire permits, <br />from these agencies for the permit file when issued. Staff has received a copy of <br />the Substitute Water Plan prepared by RHN Water Consultants for the Scott <br />Expansion:.. <br />9) Exhibit S states that an agreement with Public Service Co. of Colorado is attached. <br />The agreement, however is not in the application. Please supply a copy of the <br />damage agreement noted in Exhibit S for the application file. <br />These reviewed issues do not imply that all other requirements are met. Further adequacy <br />review will be undertaken on this application as relevant information is supplied and <br />analyzed.
