The revegetation seed application rates indicated in the application have not multiplied by the percentage of each species in the total mix. Please see the enclosed (revised) seeding plan and revise the revegetation information accordingly. 7. It is apparent that water will be required for some of the various facilities proposed to be operated on site. Please indicate where the required water will be obtained. 8. Though it does not appear that an NPDES permit will be necessary for this operation, please be aware that jurisdiction for NPDES permits is with the Colorado Department of Public Health and Environment, not the Army Corps of Engineers, as is indicated in Exhibit G. 9. Please be aware that a release request for the Nucla Pit will need to be submitted upon approval of this cohversion application, because that operation is included iri the permit area proposed in this application. 10. Proof of the required newspaper publication, adjacent landowner notification, and placement of revised application materials with the County Clerk and Recorder, need to be submitted prior to the decision due date. 11. Lynn Lewis, with the BLM in Montrose, has verbally expressed some concern with the proposed permit area and property ownership associated with this application. Lynn indicated that a written correspondence would be forthcoming. However, the Division recommends that Montrose County contact the BLM to discuss and address their concerns. The comments will be forwarded when received by the Division.
