Long <br />Division Dvenor <br />RE: BLM/West End Pit, Permit No. M-92-017, Conversion No. 1 Preliminary Adequacy Review <br />Dear Mr. Wilson: <br />The Division has reviewed Montrose County's application for Conversion No. 1 (CN-001) to the <br />reclamation permit referenced above. Preliminary adequacy review comments are listed below. <br />Please respond to these comments as soon as possible, or at least by August 25, 1998, so the <br />decision due date of September 8, 1998 can be met. If, neither your response, or a request for <br />extension of the decision due date, is received by September 8, 1998, The Division may deny the <br />application. <br />ADEQUACY COMMENTS <br />1. Mining Plan -The mining plan specifies that the pit will daylight on the south side, where <br />there will be a sediment control berm constructed. Please be aware that material may not <br />be spoiled down slope from the daylighted end of the pit either during excavation of <br />material or construction of the sediment control berm. If spillage of material over the <br />outslope is expected, please include these slopes in the affected area and reclamation plans. <br />2. Cross-sections of the pit, included on the permit maps show the disturbed area boundary to <br />be located on the inside of the sediment control berm. However, the mining plan appears to <br />indicate that the sediment control berm will be constructed from overburden. Please clarify <br />whether the sediment control berm will be constructed, and if so, please revise the indicated <br />disturbed area boundary on the pit cross-sections. <br />3. The last sentence of the first paragraph, under section D of the mining plan, indicates that <br />the NRCS does not recommend fertilizer or mulch for the revegetation process. However, <br />the NRCS recommendations in Exhibit J, and the topsoiling section of the reclamation plan <br />both indicate that the NRCS does recommend application of fertilizer and mulch. Please <br />clarify and/or correct this discrepancy so that this information is accurate and consistent <br />throughout the application. <br />The Division does not recommend the use of fertilizer in this dry climate, but the application <br />and crimping of mulch is highly recommended for all areas to be reseeded. <br />4. Reclamation Plan -The reclamation plan does not include the BLM requirements for <br />reclamation of the tract of land owned by them. Because these requirements are included in <br />Exhibit N of the application, please either include them in the reclamation plan, or include a <br />
