Cong <br />Pueblo, CO 81003 Dlvltl°n Director <br />R~': Condition No. 1, 112 Conversion .4pprovai, Mottntaitt Shadow Pit, Permit No. M-1979-158 <br />On July 26, 2000 the Colorado Mined Land Reclamation Board approved Colorado City <br />Metropolitan District's (CCMD) application to convert Permit No. M-1979-158 to a regular l l2 <br />permit, with one condition, as follows: <br />Condition No. 1 <br />a) provide, within 60 davs ojpermit iss++ance, the dimensions and location of <br />the !ox' un-mined berm to be left on the south and southeast margins of the <br />Pit; <br />b) provide the base width, top width and height and elevations for the berm's <br />entire length; <br />c) include hydrologic calculations to demonstrate that the berm and pit~loor <br />will provide detainment fora 10-year, 24-hoar storm event; <br />d) include specifications for installation of the discharge pipe, including inlet <br />and outlet structures: and <br />e) show the location of the berm and pipe on your mining plan map and <br />reclmnarion plan map, if these features will remain upon reclamation. <br />The 112 permit for this operation has not been issued, as of this date. The Division is still waiting <br />for the proper documentation to be able to accept a $95,600 financial warranty from Colorado City <br />Metropolitan District. The bond must be approved before the permit, which is still in the name of <br />Colorado City Development Company, can be transferred to Colorado City Metropolitan District. <br />Except for the bond, the documents necessary for the transfer are in place. <br />The Metro District remains under a cease and desist order from any mining activity outside the <br />original Colorado City Development Company 110 permit boundary, until the l 12 permit is issued. <br />
