Boulevard, Suite 202 <br />Gunnison, Colorado 81230 <br />Dear Ms. Cudlip: <br />We are responding to a written request dated August 31, <br />2001, on behalf of Mr. Nick Gray, for a jurisdictional <br />determination on two separate parcels of property being proposed <br />for development of gravel extraction. The properties are located <br />within Section 24, Township 49 North, Range 8 West, and within <br />Section 36. Township 49 North, Range 8 West, Montrose County, <br />Colorado. <br />Based on a site inspection and plan review by Mr. Nick Mezei <br />of this office on September 27,2001, we determined that your <br />wetland boundary delineation is accurate The plans titled Grav <br />1:: Gravel Pits Wetland Delineation and Grav 2: Gravel Pits <br />Wetland Delineation both dated 04-04-01 is an accurate depiction <br />of the limits of Federal jurisdiction under Section 404 of the <br />Clean Water Act. <br />In a letter dated August 31, 2001 from Mr. Michael Ripp to <br />the U.S. Army Corps of Engineers, it was stated that "...we <br />intend to stay out of the wetland areas and provide silt fencing <br />where appropriate so that adjacent operations will not discharge <br />material into these areas." Provided that there will not be any <br />fill material placed into jurisdictional waters of the United <br />States, a Department of the Army (404) permit will not be needed <br />for the proposed work. If at a later date it is determined that a <br />discharge of material will need to be placed into any of these <br />identified areas, the Corps of Engineers must be contacted to <br />determine permitting requirements. <br />
