Opportunity for wetland creation is very <br />limited, and wetland enhancement to increase habitat value and <br />aesthetic values would be more appropriate forms of mitigation. <br />You have verbally concurred with such a concept. You have also <br />concurred that the existing water elevation upstream of the <br />proposed main crossing will be maintained by constructing the <br />culvert invert to retain that elevation to prevent the wetland <br />complex from becoming dewatered. <br />The Chief of Engineers has issued Nationwide General permit <br />number 14 which authorizes the discharge of dredged or fill <br />material in waters of the United States for linear transportation <br />projects. We have determined that your project will not affect <br />threatened or endangered species protected by the Endangered <br />Species Act. Your project can be constructed under this <br />authority provided the work meets the conditions listed on the <br />enclosed information sheets and the Special Conditions listed <br />below. You must send a signed letter of certification to the <br />Corps of Engineers within 30 days after completion of the work <br />(see general condition number 14). A copy of the certification <br />statement is included for your use. <br />Special Conditions: <br />1. The placement of the culvert in the main channel shall be <br />accomplished in a manner that ensures the water level in the <br />upstream wetland complex shall not be lowered either during <br />construction, or after construction. <br />2_ The outfall portion of the culvert in the stain channel shall <br />be constructed is a manner which will not cause erosion or any <br />other damage to the downstream wetland complex. <br />3. -The upstream and downstream faces'of all fill material <br />adjacent to waters of the II.S. shall be stabilized in a manner <br />which will prevent the movement of sediment into waters o£ the <br />U.S. (such as by precipitation events). <br />4. Compensation for adverse impacts to waters of the U.S. shall <br />be accomplished by enhancing the existing upsteam wetland <br />complex. Bnhancament shall include the planting of at least <br />eight saplings of min~*~*+++~ 3-inch girth diameter in locations <br />around the edge of the wetland complex. These trees should <br />assist in providing visual cover for the project access road as <br />much as possible, and in a safe manner. The tree specie used <br />shall be indigenous to the locale, capable of surviving at that <br />elevation, along the edge of the wetland. Additionlly, willow <br />plantings or cuttings £rom willows on site shall be incorporated <br />
