Long <br />Division Director <br />RE: 23 Road Pit, Permit No. M-1979-089, Amendment No. 3 Preliminary Adequacy Review <br />Dear Mr. Settle: <br />DMG has completed the preliminary adequacy review of your application for an Amendment to Permit <br />No. M-1979-089 for the 23 Road Pit. The application cannot be approved until the following issues <br />are adequately addressed. Please submit a response to the following issues as soon as possible, but <br />no later than June 4, 2002 so the decision due date set for June 11; 2002 can be met. If you cannot <br />respond by June 4, 2002, please submit a written request for extension of the decision date. If your <br />.response, or an extension request, are not received by June 4, 2002 this application may be denied. <br />ADEQUACY ISSUES <br />Exhibit B -Location MaR <br />1 . The ihdex map appears to show the proposed new permit acreage and some, but not all, of the <br />current permit area. Please revise the map to include all current and proposed acreage for this <br />permit, clearly differentiating the acreage proposed by this amendment. <br />Exhibit C -Mine Plan Map <br />2. Please verify that. there are no communication lines, underground or overhead, within 200 feet of <br />the proposed affected area. If there are, please include them on this map and specify their <br />owners. <br />3. Please revise this map to specify the owner of the cell tower and the Independent Ranchman's <br />ditch. Notification of this application will need to be made with any newly identified land or <br />structure owners (if applicable) and will restart the public comment period. <br />4. Please indicate the direction of miriing for this proposed parcel. <br />5. Please clearly identify the current and proposed permit boundaries. Especially the sketchy area <br />around the Schmahl residence and 23 Road. <br />6. If the irrigation ditch and fence along the north side of the AM-02 area, within 200 feet of the <br />proposed AM-03 affected area, still exist please illustrate them on the new maps. Other fences <br />and powerlines within 200 feet of the proposed AM-03 affected area were illustrated on previous <br />maps that are not shown on the new maps. Please include these on the map if they still exist, <br />indicate their owners, and verify that the owner has been notified as required. <br />
