Long Division Director RE: 23 Road Pit, Permit No. M-1979-089, Amendment No. 3 Preliminary Adequacy Review Dear Mr. Settle: DMG has completed the preliminary adequacy review of your application for an Amendment to Permit No. M-1979-089 for the 23 Road Pit. The application cannot be approved until the following issues are adequately addressed. Please submit a response to the following issues as soon as possible, but no later than June 4, 2002 so the decision due date set for June 11; 2002 can be met. If you cannot respond by June 4, 2002, please submit a written request for extension of the decision date. If your .response, or an extension request, are not received by June 4, 2002 this application may be denied. ADEQUACY ISSUES Exhibit B -Location MaR 1 . The ihdex map appears to show the proposed new permit acreage and some, but not all, of the current permit area. Please revise the map to include all current and proposed acreage for this permit, clearly differentiating the acreage proposed by this amendment. Exhibit C -Mine Plan Map 2. Please verify that. there are no communication lines, underground or overhead, within 200 feet of the proposed affected area. If there are, please include them on this map and specify their owners. 3. Please revise this map to specify the owner of the cell tower and the Independent Ranchman's ditch. Notification of this application will need to be made with any newly identified land or structure owners (if applicable) and will restart the public comment period. 4. Please indicate the direction of miriing for this proposed parcel. 5. Please clearly identify the current and proposed permit boundaries. Especially the sketchy area around the Schmahl residence and 23 Road. 6. If the irrigation ditch and fence along the north side of the AM-02 area, within 200 feet of the proposed AM-03 affected area, still exist please illustrate them on the new maps. Other fences and powerlines within 200 feet of the proposed AM-03 affected area were illustrated on previous maps that are not shown on the new maps. Please include these on the map if they still exist, indicate their owners, and verify that the owner has been notified as required.
