Existing roads will be left in a condition equal to <br />or better than that observed on Mountain Coal Company's entry into the area or to the <br />satisfaction of the USFS representative. <br />Any coal recovered incidentally to this project will be in the form of cuttings or core and would <br />either be taken back to the mine site or disposed of in the mud pit. <br />MCC requested approval from the USFS in a letter dated May 23, 2005 to Mr. Levi Broyles, Re: <br />Mountain Coal Company LLC (MCC), West Elk Mine; Permit No. C-80-007; Methane Drainage <br />Well (MDWs) 2005 Annual Operating Plan Amendment, and has received that approval May 24, <br />2005. <br />Tentatively, MCC will begin drilling this well (24-OSB) as soon as the minor revision to the <br />permit is approved. <br />This letter will be incorporated into the permit document with MR-309 in Volume 11A. <br />Please notify me with the Division's bond liability estimate so that an•angements can be made <br />should the estimate exceed the current total bond amount of $11,500,000.00.
