<br />3 - SIGNED STATEMENT BY ROBCO <br />(Refer to cover letter and signature at end of this report) <br />4 - NARRATIVE DESCRIBING RECLAMATION AND CONFORMANCE TO RULE 6 <br />The State of Colorado and the Colorado Department of Highways <br />totally revised the grades and reclamation of the area taken for <br />the C470 right of way. They took the property with the mine <br />disturbance as it was and completely rebuilt this right of way. <br />The property isolated to the west of the right of way had never <br />been disturbed by ROBCO. A map of the highway as constructed is <br />enclosed as exhibit A. Exhibit B contains photographs of the <br />constructed ROW and also the undisturbed isolated parcel. <br />Prior to the taking and construction of the highway, ROBCO had <br />performed no reclamation on the site. <br />Because of the taking, there is no conformance nor is there non- <br />conformance to Rule 6. <br />A map of the area being requested for release is enclosed in <br />Exhibit C and titled "MINE PLAN MAP". Exhibit D, titled "AFFECTED <br />LANDS" shows the only area disturbed by ROHCO which was included in <br />the CDOH taking. This disturbed area was pre-law. <br />ROBCO is not requesting a reduction of the financial warranty as a <br />result of this partial release of property. <br />If this partial release of property under the Financial Warranty is <br />granted, ROBCO will amend the permit document with a simple <br />Technical Revision to amend the permit boundaries and to revise <br />various time tables. <br />The legal description under the financial warranty does not change <br />as a result of this request. The only change is the total number <br />of acres covered by the financial warranty. <br />The original total acreage under this Permit was 165.91 acres. <br />This partial release will result in a total of 130.46 acres covered <br />by the Permit and the Financial Warranty. Since only pre-law <br />disturbed area was taken by CDOH, there is no change in post-law <br />disturbance as a result of this action. <br />CERTIFIED MAILINGS <br />Copies of certified mailings are included in Exhibit E. <br />Please contact me at (303) 452-6611 if there is any additional <br />information or clarifications needed for the processing of this <br />request. <br />
