Permit # 2000-158 <br />This letter is in response to the inspection report dated <br />August 19, 2005 and addresses the 4 problems listed in the order <br />presented. <br />1. Enclosed is a copy of the agreement Platte Sand and Gravel <br />has with the Western Mutual Ditch. This agreement allows <br />for 3 crossings of the ditch but does not specifically spell <br />out where those crossings will be located. It also allows <br />mining to take place no closer that 160 feet from the center <br />line of the ditch. <br />2. Our attorney has been working with Kerr-McGee to complete <br />the surface use agreement for the mined area for over 6 <br />months. He and Kerr's attorneys plan to have a marathon <br />meeting starting at 4:00 P.M. on October 3, 2005 and work <br />until a finalized agreement is reached. This is a result of <br />personnel changes at Kerr-McGee. Don French retired and <br />Chris Greneaux transferred to Louisiana, both gentlemen were <br />working on the agreement. The new contacts have been slow <br />on the uptake but we expect to have a signed agreement by <br />the end of the week. A copy will be presented to the Divi- <br />sion as soon as it is completed. in the mean time, these <br />lines are buried a minimum of 40 inches deep and have an <br />additional 12 to 30 inches more road base cover where the <br />haul road crosses them. This is adequate cover for these 2 <br />inch diameter lines. <br />Attached is a copy of the Xcel Energy powerline crossing <br />agreement with Rocky Hoffschneider's signature on it and a <br />copy of a letter from them confirming that the agreement was <br />being signed. Platte Sand & Gravel LLC has never received a <br />copy of the agreement with a signature from an Xcel repre- <br />sentative. Numerous requests for a copy have been made to <br />no avail. Doug Dalton retired from Xcel last year and Steve <br />O'Brian faxed a request to George Webb in their office in <br />Ft. Collins on 9119105 to see if we can obtain a copy with <br />
