<br />July 12, 1999 <br />Mr. Jim Dillie <br />Page 2 <br />The attached Table 1 presents projected disturbances for the current mine plan. These <br />projected disturbances are based on projected clay demands and backflling requirements <br />prior to initiating bond release on the lands currently classified as moderate/minor <br />disturbance. The major disturbance component of 35 acres is marginally adequate. As <br />already stated above, ROBCo needs additional moderate and minor acreage included in <br />the permit. <br />Also attached is a draft version of Exhibit E. ROBCo will formally submit a change to <br />Exhibit E to be incorporated with the current Apache Mine amendment application. This <br />change is presented in Draft form as the Exhibit E replacement page. The changes aze <br />marked in bold with old text doublestriked. <br />While the major disturbance component of 35 acres is adequate, the amendment reflects a <br />change from 35 acres to 40 acres for major disturbance. This includes 1.5 acres of <br />surface water runoff structures in the north and 1.0 acres of surface water runoff <br />structures in the south and an allowance for delay in the reclamation in the central <br />stockpiles reclamation. <br />Projected disturbances prior to bond-release of the existing 23.2 acres of moderate/minor <br />disturbed lands includes an additional 16.7 acres. Requesting an additional 30 acres of <br />moderate/minor disturbance for a total disturbance of 45 acres allows continuing <br />operations prior to formal bond release. <br />Since ROBCo has currently scheduled to resume mine operations and required surface <br />water runoff work during the week of June 19, 1999, I request that the Division approve <br />the interim variance for an additional 3.5 acres as soon as possible so these activities can <br />proceed. <br />If there are any questions, or I may be of further assistance, please contact me.
