Robinson Brick Company (ROBCo) requests an additional 3.5 acres of major <br />disturbance prior to approval of the submitted Apache Mine amendment application. <br />This variance is requested to allow continued mine operations and allow construction of <br />surface water runoffcontrol features. The 3.5 acres allows an additional 2.0 acres of <br />disturbance for mining, 0.5 acres of disturbance for undisturbed surface water runoff <br />diversion, and 1.0 acres for construction of an erosion control dam. <br />A June 25th letter to the Division reported current total disturbance of 52.4 acres <br />(including the South road and ponds which will remain after reclamation). This <br />disturbance was classified as 29.2 acres of major disturbance and 23.2 acres of moderate <br />and/or minor disturbance. The Apache Mine and Reclamation plan states "The total <br />disturbed area at any one time will not exceed 50 acres. Of that 50 acres, no more than <br />35 acres will need partial backfilling and recoiling (major); any disturbed acreage on the <br />remaining 15 acres will have been backfilled and recoiled (moderate/minor) and in the <br />final stages of reclamation." The requested vaziance of an additional 3.5 acres of major <br />disturbance brings the total disturbance to 55.9 acres, with 32.7 acres of major <br />disturbance and 23.2 acres ofmoderate/minor disturbance. <br />As can be seen from the above numbers, the Apache Mine continues to operate within the <br />permitted 35 acres of major disturbance. The 50-acre limit is exceeded as no-bond <br />release has occurred on any of the reclaimed acres to date.
