Section 34- <br />32-109(6) requiring them to be responsible for assuring that their <br />operation and post mining land use will comply with local la-d use <br />regulations and any master plan for extraction adopted pursuant to <br />Section 34-1-304; or that the tympany has a clearance from the State <br />Fhgineer with regard to administration of water rights; or a <br />clearance from the Colorado Department of Health with regard to the <br />discharge of pollutants into the waters of the state; or a cle~azance <br />from the same department with regard to the need for a fugitive dust <br />permit; or a clearance from the U. S. Army Corps of Fhc~ineers <br />regarding a dredge and fill permit, and <br />FMS, the City of Manitou Springs is dependent upon tourism arr] believes <br />that the further destruction of the natural landscape in such a <br />visible manner will affect tourism in a negative way; <br />NCW, '1~OI~, BS IT I~OLVBfl SY TBiE CPl'SC CD~1(:IL Q+ THE CI'1'fL Q~ FQ~II'1+0[I <br />SPRII~S, OOI~tIlDO, THAT: <br />S17ClZQ~1 1: The City of Manitou Springs opposes this expansion because it may <br />pose threats to the health, safety and welfare of the citizens of <br />Manitou Springs. ! <br />SH(TIQ~1 2: The City implores members of the Mined Land Reclamation Bo rd to <br />provide the City of Manitou Springs with ceasonable as:iurance <br />that they will pursue with due diligence an exhaustive review of <br />the Castle Concrete Company's application for an amendment of its <br />permit to mine the Snyder Quarry. <br />SHCIZQJ 3: The City expects that the Board will hold the Castle Concrete <br />Company accountable for compliance with all applicable (local, <br />county, state and federal law. <br />SECTION 4: The City urges the Board to establish requirements for the <br />applicant that will provide adequate safeguards: <br />A. Against personal injury from rocks falling into Williams <br />Canyon during mining operations. <br />B. Against increased air and water pollution particularly as <br />they might affect the current designation of Fountain Creek. <br />C. Against increased water run-off due to reduced vegEtation <br />that may increase flash floods in Williams Canyon and the <br />City of Manitou Springs. <br />D. Against destruction of invaluable geological formations >n <br />Williams Canyon and adjacent areas from blasting and the <br />operation of earth moving equipment. <br />
