c. Road Tmprov7*fncnt Scheclulc - Snornnass Coal will be
responsihlifor Lhc design, construction and maintenance
of all sCages of improvements Lo the; road access within
Yi.ti:in County in support of the Snowmass Co=r1 mining
activities. A11 such improvements shall be submitted to
and reasonably approved by the Pitkin County Engineer.
Improvement shall be implemented according to the
report,"Anschutz Coal Company - Roadway Access" prepared
by Briscoe, Maphis, t4urray b Lamont, Inc., which is
hereby incorporated as a condition of this permit
(Exhibit P'), anc] according to the Amended Permit
Application.

d. Pitkin County shall pay to Snowmass Coal a sum not
exceeding (a) the gross ton-mile tax revenues generated
• by this Snowmass Coal operation and received by Pitkin
County or (b) Snowmass Coal's actual maintenance and
road construction costs, whichever is less. Pitkin County
shall have no further liability other than as stated for
payment or reimbursement of Snowmass Coal for required
road improvements. _
e. Snowmass Coal agrees to apply for and obtain building
permits for construction of new roads on the lands within
• Pitkin County.
18. Mine 12efuse fire - Snowmass Coal recognizes the hazard presented
by the burninG of old refuse above the existing refuse
disposal site. Snowmass Coil agrees to extinguish this fire
as soon as possible according to the plan contained in Section
5.0 (pp. 58-59) of the Amended Mine Permit. Snowmass Coal will
notify the County Environmantal Coordinator ,upon completion of
this work.
19. Fire Protection - Fire protection will be the responsibility of
Sno~.~mass Coal and will be provided by fire control systems,
including high pressure pumps, as well as chemical fire
extinguishers strategically located. Snowmass Coal agrees to
immediately notify the O.S. Forest Service if any fire should
develop on the Lands which may threaten federal lands or require
federal assistance to extinquisli.
20. Security of the Property and Equipment - Security of property
of Snoorniass Coal shall be the responsibility of Snowmass Coal.
The Pitkin County Shcri.f.t's Uffi~e shall be informed of any
acts reyuiriny their notification.

amendment to thew permit con3itions.
22. Change in Ownership - In the event of any change of ownership
fee or. lease in the Lands, Snowmass Coal shall notify the
lesee of the terms of this permit by letter, a copy of which
shall he forwarded to the Board. In the event Snowmass Coal is
succeeded in operation on the Lands by legal process or order of
court, the new operator shall be required to maY<e application
to the Board for approval of it and for continuance w7der Chis
permit, which approval shall not be unreasonably withheld.
23. Fecordai.i.on of Permit = Ti~is permit shall be recorded in the
office of the PPitkin County C].erk and Fecorder, and shall
constitute a burden running with the land.
24. Public Liability Insurance - Snowmass Coal agrees t.o post with
the Roars] a public l.iahii~.ty insurance policy in the initial sum
of $300.,000 for- the benefit and purpose Eor the protection of
Pitkin County, and to indemnify and hold harmless the County,
