Road Tmprov7*fncnt Scheclulc - Snornnass Coal will be <br />responsihlifor Lhc design, construction and maintenance <br />of all sCages of improvements Lo the; road access within <br />Yi.ti:in County in support of the Snowmass Co=r1 mining <br />activities. A11 such improvements shall be submitted to <br />and reasonably approved by the Pitkin County Engineer. <br />Improvement shall be implemented according to the <br />report,"Anschutz Coal Company - Roadway Access" prepared <br />by Briscoe, Maphis, t4urray b Lamont, Inc., which is <br />hereby incorporated as a condition of this permit <br />(Exhibit P'), anc] according to the Amended Permit <br />Application. <br /> <br />d. Pitkin County shall pay to Snowmass Coal a sum not <br />exceeding (a) the gross ton-mile tax revenues generated <br />• by this Snowmass Coal operation and received by Pitkin <br />County or (b) Snowmass Coal's actual maintenance and <br />road construction costs, whichever is less. Pitkin County <br />shall have no further liability other than as stated for <br />payment or reimbursement of Snowmass Coal for required <br />road improvements. _ <br />e. Snowmass Coal agrees to apply for and obtain building <br />permits for construction of new roads on the lands within <br />• Pitkin County. <br />18. Mine 12efuse fire - Snowmass Coal recognizes the hazard presented <br />by the burninG of old refuse above the existing refuse <br />disposal site. Snowmass Coil agrees to extinguish this fire <br />as soon as possible according to the plan contained in Section <br />5.0 (pp. 58-59) of the Amended Mine Permit. Snowmass Coal will <br />notify the County Environmantal Coordinator ,upon completion of <br />this work. <br />19. Fire Protection - Fire protection will be the responsibility of <br />Sno~.~mass Coal and will be provided by fire control systems, <br />including high pressure pumps, as well as chemical fire <br />extinguishers strategically located. Snowmass Coal agrees to <br />immediately notify the O.S. Forest Service if any fire should <br />develop on the Lands which may threaten federal lands or require <br />federal assistance to extinquisli. <br />20. Security of the Property and Equipment - Security of property <br />of Snoorniass Coal shall be the responsibility of Snowmass Coal. <br />The Pitkin County Shcri.f.t's Uffi~e shall be informed of any <br />acts reyuiriny their notification. <br />:. 1. Additional Mine Portal,, etc. -• The opening of additional mine <br />pori:~ls or creation of new curt-off or effluent discharge points <br />into t:orth 'Phompson Cree;: or ether streams shall require an <br />amendment to thew permit con3itions. <br />22. Change in Ownership - In the event of any change of ownership <br />fee or. lease in the Lands, Snowmass Coal shall notify the <br />lesee of the terms of this permit by letter, a copy of which <br />shall he forwarded to the Board. In the event Snowmass Coal is <br />succeeded in operation on the Lands by legal process or order of <br />court, the new operator shall be required to maY<e application <br />to the Board for approval of it and for continuance w7der Chis <br />permit, which approval shall not be unreasonably withheld. <br />23. Fecordai.i.on of Permit = Ti~is permit shall be recorded in the <br />office of the PPitkin County C].erk and Fecorder, and shall <br />constitute a burden running with the land. <br />24.
