n <br /> <br /> <br />Coal shall sul~mi.t to tlic County evidence, as it becomes available, <br />of compliance with 0.:,.t4. and/or M.L.lt.B. regulations, approvals <br />from those agencies as they arc obtained, and copies of all <br />inspection reports issued by those agencies as they are issued. <br />3. Reclamation, Revegetation and General Operations The applicant <br />shall reseed and revegoCate and disturbed areas on the mine <br />site according to the plan described in Section 7.0 of the <br />Consolidated Mine and Reclamation Permit Amendment for Snowmass <br />Coal Company's North Thompson Creek Mines and Loadout Facility of <br />May 15, 1980 (hereinafter known as the Amended Permit Application) <br />and relevant sections of M.L.R.B. Permit #77-313, both of which <br />are on file with the Pitkin County Clerk. The progress and effect- <br />iveness of revegetation will be assessed during yearly site <br />inppection commencing on August 15, 1980, and continuing at yearly <br />intervals from that point forward on August 15 of each year, or <br />on another date as determined by the Board. At those times the ~,. <br />status of revegetation will be compared to the maps, goals, and <br />timetables of those plans and permits by appropriate County staff, <br />with special attention to the following concerns: <br />A. Coal conveyers from mine portals to wash plant, crusher and <br />storage silos must be fitted with deflection shields designed <br />to prevent any spillage from said conveyers into the Thompson <br />Creek streambed. Such shields will be installed as soon as is <br />practical using the design as contained in the Amended <br />Permit Application. <br />B. Successful revegetation of the slopes between the road to the <br />#3 mine portal and the Thomoson Creek streambed haves been cited <br />as being particularly critical to successful control of <br />surface runoff and preservation of stream quality. According <br />to the reseeding schedule included in Permit #77-313, this <br />area was to be reseeded in April of 1979, which reseeding <br />was apparently only marginally successful. This area's <br />revegetation should be made top priority in order to fully <br />assure the continued quality of North Thompson Creek. Snow- <br />mass Coal will submit a report to the County within 90 days of <br />final approval of this permit detailing this revegetation. <br />C. At all times Srowmass Coal will conduct operations so as to <br />pr sent or control on-site and off-site damage to the environ- <br />ment and public he4lth or safety, relating to or caused by <br />SnowmasG Coal's operations on the Lands, including, but not <br />limited to: <br />(i). Control of erosion, rockfali, and landscapes. <br />(ii). Isolation, removal or control of toxic matFrials. <br />4. Agticu]tural Conservation - Snowmass Coal shall coordinate its <br />mining eperations tiith the reasonable movemen~. of cattle through <br />the Lanus by the North Thompson-Four Mile Mineral and Land Corp- <br />oration and other stock users of the County read through the <br />Lands so as not to adversely affect the reasonable movement of <br />cattle or existing agricultural uses in the area without the <br />consent of those engaged in such activities. <br />5. Wildlife Snowmass Coal has recognized in previous special use <br />perrnr.ts the hazard that their operation presents to wildlife in <br />the Eorm of increased probabilities of road kills and poacliinq. <br />These hazards have been confirmed and documented by the Division <br />cf tvildlifc ncrsonncl in the report of 7/19/80 by Jim Goodyear, <br />District Wildlife Manager, }~ereunder attached as Exhibit A. <br />It is the opinion of l.'itkin County and the Division of Wildlife <br />that these hazards can best be mitigated through the institution <br />of a van-pool or comparable mass-transit program.
