'. <br />reclamation liability associated with this TR. <br />CEC believes that a TR is the appropriate authorization mechanism <br />for this proposed activity due to the inconsequential nature of the <br />associated environmental impacts. The total area of potential <br />disturbance will be less than 0.25 acres and reclaimed within 6 <br />months of the activity. Aa provided in Rule 2.06.8 (Surface Coal <br />Mining and Reclamation Operations on Areas, or Adjacent to Areas, <br />Including Alluvial Valley Floors) of the Regulations of the <br />Colorado Mined Land Reclamation Board for Coal Mining, permit or <br />permit revision applications for operations in alluvial valley <br />floors (AVFs) can only be approved if the proposed operation <br />"would: <br />Not interrupt, discontinue or preclude farming on alluvial <br />valley floors that are irrigated or naturally subirrigated, <br />excluding undeveloped rangelands which are not significant to <br />farming on said alluvial valley floors and those lands upon <br />which the Division or Board finds that the farming which will <br />be interrupted, discontinued, or precluded is of such small <br />acreage as to be of negligible impact to the farm's <br />agricultural production;". <br />Given the facts that 1)the AVF area in question is undeveloped <br />rangeland, 2) there is no farming activity which will be disrupted, <br />and 3) an insignificant area will be temporarily disturbed, CEC <br />requests that this action be approved under a TR. <br />A list of materials which have been included in order to facilitate <br />the Division's review of this request is attached.
