The Board may consider the equest to contain some major impact <br />factors, and advise the applicant~t a review and special use permit will <br />be required. An application is then made to the Planning Commission for <br />processing in agreement with the regulations set forth in Section 19.II. <br />with a mandatory public hearing. <br />D. Discontinuance ofNon-conforming Uses <br />I . In the event that anon-conforming use is discontinued fort <br />a period of360 days, such use shall not be reestablished except by <br />special use permit. Hardship cases in which discontinuance <br />occurs (for legal or economical reasons) may have the 360 day <br />limit extended for a reasonable period of time by the Board of <br />County Commissioners,prtoviding the written application forsuch <br />extension is received bythe Board o£county Commissioners prior <br />to the expiration of the original 360 day period. <br />Discontinuance as used in this regulation means failure to continue regularly day <br />to day, the activities of the non-conforming use; to cease a service or use, or <br />terminate a condition. Discontinuance starts the first day services, uses or <br />conditions are not available to the public. <br />2. Mobile homes removed from a site (other than a designated <br />mobile home park) for 30 days or more shall not have the use <br />reestablished except by special use permit. <br />3. Anon-conforming sign which is removed and not replaced by an <br />approved sign within 30 days shall not have the sign use reestablished except by <br />permit processed as a new sign. <br />We believe that Hard Rock meets this definition of aNon-Conforming Use (grandfather) and in <br />October of 1997 the Chaffee County Board of Commissioners approved an expansion ofthis use (see <br />attached minutes). So long as Hard Rock Paving and Redi Mix, Inc. meets these above standards or <br />until said regulations are changed, we believe they are and will conform to the Chaffee County Zoning <br />Regulations.
