In furtherance of our telephone conversation on the 9th, I was able to
have a meeting with Red Cortner. At that time we spoke by phone with
Larry Osborn, the local rancher who leased the pasture in question last
summer and who did the spraying.
Cross Mountain Ranch can certainly understand the desire of your client
to minimize adminatrative expense and obtain some closure as to this
matter. But, at the same time, Cross Mountain Ranch is reluctant to
quantify the amount it is willing to accept for weed control out of the
extra $10,000.00 being held by the Division of Minerals and Geology.
Stated another way, Cross Mountain Ranch reasonably believes that after
the dust settles, the cost for weed control caused by the disturbance
under this permit will exceed the sum of $10,000.00, possibly by a
considerable amount.
Conversely, Cross Mountain Ranch has no interest in being unjustly
enriched at the expense of your client. If your client really wants
"loose", Cross Mountain Ranch is willing to agree that the whole
$10,000.00 be escrowed for weed control, subject to the reasonable
supervision and consent of the Division of Minerals and Geology. To
the extent not expended for these purposes over a period of say four
years, the balance would be added to the $25,000.00 being held by the
Department.
