Dear Interested Persons,
This memo is intended to serve as a clarification of who is considered to be a "party" to the
above-named matter, versus +vho is involved in the matter as an "interested person."
Additionally, [his memo will provide an update on the review process of [he application.
The following items define who may be considered a "`party" to this matter:
the Applicant;
2. Objectors, +vho submitted +vitten objections before the close of the public
comment period, and did not withdraw as a party, nor request to be a non-parri'; and
3. Objectors, vvho did not submit +vitten objections during the public comment
period, but +vho attended the Informal Conference to object to the application, and who
then submitted written objections within five working days after the Lrfonnal
Conference.
Othcr persons who are involved in [he matter are cousidered as an "interested person," as defined
by the following points:
I . All persons +vho submitted written comments before the end of the public
comment period, in support of the Nichols application, regardless of whether [hey
subsequently chose to +vithdra+v or be named as a non-party;
2. All persons who submitted written comments before the end of the public
comment period, in objection ro the Nichols application, but +vho subsequen[h~ withdrew
aS a party or requested to be a non-party;
3. All persons who attended the Informal Conference as a supporter of the
applicant, and have not previously submitted timely +vrtten objections;
4. All persons who attended the Informal Conference as an objector to [he
application, and who had submitted timely written objections and then +vithdrawn or
chose non-party status; and
