The proposed mining and reclamation operations can be carried out in <br />ctmformance wi[h the requiarrtertu of the Act, and the Construction Material Rules and Regulations. <br />E. The Perminee has made a showing satisfactory ro the Board: 1) chat it will employ, dtuing <br />and afer its underground training andtor surfxe operatiotrs, procedures designed to minimize environmental <br />disturbance from such operation; 2) that. it will provide for redatrration of the Affected lands appropria[e to <br />the subsequent benetieial use of such rands; and 3) that, in the event of the failure of its proposed <br />reclamation plan, it will take whatever measures may be necessary to assure the success of reclmnation of <br />the lands affected by such operations in accordance with the Act. <br />F. A copy of dte Permittee's application, as amended and supplemented, hae been approved by <br />the Board and is, by this reference, incorporated herein. <br />G. The issuance of this pernilt does no[ relieve you from having to comply with all applicable <br />Fedz-cal, State and County stanttes, including Srate water law. <br />GRANTS. CONDTITONS AND AGREEIv1FNTS <br />The Board, in reliance upon the rcpresentarions and promises made in dte permit applicarion, as <br />amended and supplemented, and the performance warranty, hereby issues a life of the mine permit to Ne <br />Permittee, to engage in the operations desgibed in the application an certain ]ands lying in the County of <br />Montrose, State of Colorado. These lands are described in the permit application, as amended and <br />wpplcrrtet[ted, and are referred to herein as the "Affected Lands". <br />This permit is isaucd subject to the following conditions and agrtxments: <br />1) The Permittee will be bound by al] applicable requiremems of the Act, and all applicable <br />ales and regulations of the Board, as amended from tune to time, the terms of the permit application. the <br />tetrtu of the performance warranty, and the terms of [he financial warrttilty filed with the Division. <br />2) The Perminee will file with the Division its annual rnport and fees on each anniversary dale <br />of [his permi[. <br />3) if analyses of the mining and recltunation operation and the data collecred through <br />monitoring and expetitnenm[ion by the Pemdttee or trtonitoring by the Division indicate the[ the operation <br />will not be able to comply wilt the requiremen[s of the Act and applicable rules and regulations of the <br />Board, the Permittee hereby agrees ro exercise its best effons, after consulting with [hc Division, to modify <br />thz plans to correct such deficiencies in the future. Such modifications may require technical revisions or <br />amendmen[s to the permit. <br />4) The Board, or its authorized representative may enter upon the lands of the permitted <br />operation az all reasonable [irrtes for the purpose of inspection to determine whether the provisions of the <br />Act, Rules and Regulations, and permi[ have been complied wi[h pursuant to C.R.S. 34-32.5-121. <br />S) This permit may be revoked or suspended for non-compliance with the Ac[ or applicable <br />rules or regulations promulgatM by the Board, the permit, or by violarion of a Board Orda•. <br />6) a) Pursuant to 3432.5-178(5) of the Act. the $oard has a right of en[ry w reclaim [ha <br />
