The Petmittee, Nick H. Gray desires to conduct a mining operation known as Gray Pit #I, <br />for the purpose of extracting sand and gravel. The PeTmittee will not [nine any secondary commodities. <br />B. On July 12, 2002 the Mined Land Reclamation Board ([he "Board") approved the <br />Perrrtittce's application for this permit, feed the amount of rho financial warrattry and directed that this <br />permit be issued upon the filing with the Division of Minaais and Geology (the "Division") of performance <br />wattanty and financial warrutry (or warranties) in the amount so fined in form and substance approved by <br />the Division. Said wattanties have been filed widt the Division. <br />C. If the PerTnittea desires to extract materials other than those liucd in (A), a separate petmi[ <br />may be required. <br />D. Land Reclamation Act for the Extraction of Construction Materials, C.R.S. 3432.5-]01 et sew., as <br />amrnded, and with all applicable local, attttc Imd fcdcrnl laws; <br />2. The operation will not adversely affect the stability of any si~»ficant, valuablt, <br />and permanent man-made structure located within two hundred feet of the Affected Land, except where <br />there is an agreement between the Operator and the persons having an imerest in the structure [hat damage <br />to the structure is to be compensated for by the Pemtinee; and: <br />
