GEOTECHNICAL STABILITY EXHIBIT
32. The Division agrees that [he slope stability analysis in the original permit and approved by the Division for
those slopes adjacent to the Fulton Ditch and [he Excel Energy Power Poles is adequate as i[ relates [o those
same structures in [he amendment azea. However, your plan shows that the O.SH : 1 V tempotazy highwall
along the east property line is as much as 30 feet higher than the highwalls reviewed for the original permit.
Added highwall height, especially if it is neazly doubled will greatly affect slope stability. Provide a slope
stability analysis for [he east highwall and demonstrate that your extraction plans for [hat azea will not
create concern for off-site damage or stability problems for the structures listed in items 30 and 31 above.
Stipulation No. 1
"Mining will no[ occur within two fee[ of [he groundwater table in any azea where groundwater is no[
already exposed to the surface until [he State Engineer's Office approves a substitute supply plan or another plan
that allows such exposure of ground water." Please state whether you agree to this stipulation as a condition for the
approval of Amendment No. 1.
