EXHIBIT F -Reclamation Plan Map <br />24. Section 6.4.6(b) of the Rules requires that [his map portray the proposed final land use for each portion of <br />the affected lands. Please show on your map the approximate boundazy between exposed water surface, <br />wetlands and upland (dry) azeas. <br />EXHIBIT G -Water Information <br />25. In accordance with Rule 6.4.7(2)(a), locate on [he "Exhibit C Map" [he three Kazen Topper wells and all <br />other wells within 600 fee[ of the amendment azea affected lands. <br />26. Your response to the requirements of this exhibit appears to be information the State Engineer's Office <br />would need for a Substitute Supply Plan or an Augmentation Plan. Please provide responses [o all of the <br />applicable requirements of Section 6.4.7(2)(a)(b)(c) (3)(4) and (5), which requires an affirmative statement <br />[hat the operator /applicant has acquired (or has applied for) a National Pollutant Discharge Elimination <br />System (NPDES) permit from the Water Quality Control Division at the Colorado Department of Health, <br />if necessary. <br />EXHIBIT H -Wildlife Information <br />27. The Division of Wildlife letter from Stephanie Durno, District Wildlife Manager is a brief overview and <br />not based on a review of the amendment proposal or an in-depth on-site inspection of [he property. The <br />DOW cannot comment on the application after the end of the comment period. However, you should <br />obtain a copy of any more in-depth analysis the DOW prepazes/ed for Adams County plus other wildlife <br />information available on the azea to address Section 6.4.9(1)(c )(the presence and estimated population of <br />threatened or endangered species from either federal or state lists). Ms Durno says in her letter that there is <br />a very good possibility of nesting birds, particulazly raptors in [he proposed amendment azea. Because <br />these birds and their nests are protected at the state and federal levels, she recommends a nesting bird <br />survey prior to any development. She says the best time of yeaz for this to be done is during nesting season <br />in eazly May. Aggregate Industries should consider conducting such a survey to protect itself from <br />inadvertently breaking state or federal law regazding protected birds and their nests. <br />28. The DOW letter in your exhibit makes some recommendations such as irregulaz shorelines and the addition <br />of one or more islands 15'x25' per 2 surface acres of constructed water surface. Please state whether you <br />will incorporate her recommendation in your application and if so, make the appropriate additions. <br />EXHIBIT L -Reclamation Costs <br />29. This exhibit will be reviewed separately so [ha[ the applicant can have [he bulk of the review items as soon <br />as possible. Responses to these review items may change [he Reclamation Cost calculations. <br />EXHIBIT S -Permanent Man-Made Structures <br />30. Given that the mining limit set back from adjacent property is 35 feet from the east propeRy line, it is <br />evident from the pre-operation inspection and scaled measurements from [he Mining Plan Map [hat a fence <br />on the property line and a residence and out building on [he Topper property and buildings on the Gibson <br />property aze within 200 feet of affected (mined) land. Please add these structures to this exhibit and <br />address them in accordance with Rule 6.4.19(a)(b)(c). <br />31. Ms Topper, in her objection letter located her wells and well vault within 200 feet of the affected (mined) <br />land boundary. Locate these wells on [he Pre-Mining Plan Map, Exhibit C, list them in this exhibit and <br />address [hem in accordance with Rule 6.4.19(a)(b)(c). <br />
