Pursuant to Rule
1.4.5(3), the date for the Division's recommendation was set at
September 29, 1995. On that date, the Division of Minerals and
Geology decided to recommend with one condition that the Colorado
Mined Land Reclamation Board approve your 112 Amendment Application
to the Bromley Lakes Pit Permit [in accordance with Rule 1.4.5(6)].
The condition pertains to the operator's optional plan for a slurry
wall-clay liner alternative.
STIPULATION NO. 1
The operator will submit the engineering specifications for the
optional slurry wall-clay liner alternative in the form of an
amendment to the permit. The amendment must be approved by the
Division before installation is begun.
In accordance with Rule 1.4.8(a), this matter has been scheduled
for the October 18-19, 1995 Board meeting for a final decision. The
hearing will be held in Room 318 of 1313 Sherman Street, Denver,
Colorado, beginning at 9:00 a.m. or as soon thereafter as the
matter can be considered. A prehearing conference will be held on
October 10, 1995. The details for that meeting are enclosed.
The Division has completed a review of the reclamation costs and
calculated the required reclamation bond at $136,688.00
(calculations enclosed). The bond is currently set at $125,250.00.
The operator must submit a rider to the current bond for the
difference of $11,438.00 or submit a new bond for $136,688.00
