<br />8. 1 There is damage and erosion along our common property line on the south side of our <br />s~1f7~ land. (Richard and Sharon Wolfe) <br />This item does not relate to an application Exhibit <br />DIVISION RATIONALE -ITEM NO.8 <br />The Division identified the same problem (No. 5 of the February 3, 1999 inspection report). The <br />operator is in compliance with the corrective action which was to agree to reclaim the <br />disturbance which was attributed to the previous permittee. The operator has graded topsoiled <br />and completed the work to revegetate the area. Some minor erosion is present on the reclamation <br />site. <br />9. `~~ I ' Hard Rock has failed to determine proper boundaries insetting limits to their operation to <br />the west. (Richard and Sharon Wolfe) <br />This item relates to Exhibit C of the application <br />DIVISION RATIONALE -ITEM N0.9 <br />The applicant has prepared a new Mining Plan Map in response to a Division adequacy concern <br />regarding the 20-foot wide access easement on the west side of the proposed permit area. Hard <br />Rock has given to residents living in the area an access easement to their homes. The response to <br />the Division concern limits mining related disturbances to land east of the easement. In <br />compliance with Rule 6.4.19, the west boundary is set where the mining operation will have no <br />adverse affect on significant, valuable, or permanent man-made structures. <br />] 0. They (Hard Rock Paving and Redi-Mix, Inc.) have not proven to be good "stewazds of the <br />land" and should not be trusted to return the land to a good condition when their proposed <br />permit expires.
