The uses permitted shall be the extraction of coal as <br />described in the Proposed Mine Plan set forth in the <br />~' Environmental Document Keenes u~ Mine Site, Weld County, <br />Colorado, prepared by the Regulatory Affairs Department, <br />A~olp oors Company, 1979. Said document is on file with <br />the Weld County Department of Planning Services. Additionally, <br />all uses permitted by right in Section 3.3B of the Weld <br />County Zoning Resolution. <br />2. No excavation or processing of coal shall be permitted nearer <br />than 10 feet to the boundary of adjacent property, easement <br />or irrigation ditch or right-of-way, nor nearer than 125 feet <br />to any existing residence, unless by written agreement the <br />owner or owners of such adjacent property consent to a lesser <br />distance and the Planning Commission approves such lesser <br />distance. The Planning Commission .may set a greater distance <br />than mentioned above when, in their opinion, it is j,,stified. <br />3... 1'he special Use Permit area shall be maintained in sixr_h a mannaY <br />so as Lo prevent soil erosion, fugitive dust and growth of <br />noxious weeds. The site shall be maintained in such a manner <br />as to present a neat and well kept appearance. <br />4. Existing trees and ground cover along public road frontage <br />and drainageways shall be preserved, maintained and supplemented <br />if necessary, for the depth of the setback in order to protect <br />against and/or reduce noise, dust and erosion. <br />5. All access roads from surface coal mining operations to public <br />highways, roads, or streets, or to adjoining residential <br />structures, shall be paved or otherwise treated to minimize <br />dust conditions on all parts of such access roads which are <br />located within one-fourth mile of the public highways, road, <br />street, or adjoining residential structure. <br />6. Excavation generated traffic of a commercial nature shall be <br />required to utilize the haul road as shown on the Special Use <br />Permit plan. The point of access for tt~e haul road shall be <br />at County Road.54, south of the Special Use Yermit area. <br />
