Reclamation Resources, Inc. has already violated its proposed berm to <br />streambank 50 feet buffer. <br />It is apparent that all but a small Part of R.R.I. 's miming activities <br />will be within their approved permit boundary, However,'a small portion <br />(1D-20 feet) of the berm (dam) fora sediment control p nd is witnin the <br />stream channel and a larger but still insignificant por ion of the berm <br />is within 50 feet of the stream bank. <br />The mining company has agreed to protect the stream fro sedimentation by <br />stabilizing the portion of the berm that is near or adj cent to the <br />stream channel. The rest of the berm is far enough awa from the channel <br />that native vegetation will filter material eroded from the berm and keep <br />it from reaching the river. The berm stabilization wit be completed <br />this growing season and will consist of tops oiling, pla ting an approved <br />grass mix, fertilizing, mulching and placing an erosion control net to <br />hold these revegetation measures in place. The entire erm will oe <br />graded to a gentle slope by pushing it into the pond ar a, upon <br />completion of mining. The mine operator has also agree to broadcast <br />seed all final graded portions of the mine that were pr viously <br />disturbed, even though this is note requirement. <br />The operator will further amend his permit boundary to include the sma71 <br />area of berm, that is out of the present boundary area and add the <br />reclamation costs to the reclamation bond recommendati n. <br />3. Reclamation Resources, lnc. has canmitted a "property ~'njury" to the <br />Colorado Division of Wildlife whic:. has ~ 66 foot Righ#r of Way Easement <br />for public fishing ... <br />This issue should be resolved bettyeen the DOk' and P..R.~., as it appears <br />to be a question of land ownership and access. <br />OTHc.R CONCERNS <br />1. The sediment pond berm; because of its proximity to thLp river, its steep <br />banks and soil composition, presents a very real erosi~n and water <br />quality threat, and a high potential for breach. <br />Reclamation Resources, Inc. has cortmitted to stabiliz the small portion <br />of the berm that is adjacent to the stream bank. Sta ilization <br />procedures will consist of placing topsoil, see_dino a orass mix, <br />fertilization, mulching and using netting to hold the e reclamation <br />measures in place. The entire berm is a temporary fe ture and will be <br />dozed into the pond area and graded to a gentle slope after mining. kith <br />the exception of the sma71 portion adjacent to the st eam, tnere is a <br />buffer of shrubs, grasses, and (orbs on gentle slopes between the berm <br />and the stream. This vegetated buffer strip has beer. acting as a filter <br />and settling area, keeping sediment from reaching the stream. Tne <br />Division has requested recirculation pond designs than will handle a <br />5-year 6-hour storm event incorporating one foot of f eeooard plus <br />operating volume. The approved lesion should preven` breaching before <br />site reclamation. <br />
